ARKA Living Trade Program
Terms and Conditions

1. Eligibility

The Trade Program is available exclusively to licensed or accredited professionals in interior design, architecture, real estate development, property staging, and related fields. ARKA Living reserves the right to request documentation that verifies professional status and to approve or deny any application in its sole discretion.

2. Application and Account

Applicants must complete the Trade Program application truthfully and supply current contact and business information. Approved members will receive a unique account that is personal and non‑transferable. Members are responsible for maintaining the confidentiality of login credentials and for all activities conducted through their account.

3. Use of Benefits

Trade pricing and other privileges are intended solely for purchases made on behalf of the member’s clients or projects. Products acquired through the program may not be resold through retail stores, online marketplaces, print catalogues, or any other direct‑to‑consumer channel. ARKA Living may request proof of end use at any time.

4. Orders and Payments

All orders are subject to ARKA Living’s standard terms of sale, including lead times, shipping charges, and payment schedules. Trade discounts apply to merchandise subtotals only and exclude shipping, taxes, custom duties, or additional services. Orders are binding upon confirmation and may not be altered or cancelled without written consent from ARKA Living.

5. Taxes and Compliance

Members are responsible for providing any applicable resale certificates and for remitting all sales, use, or value‑added taxes that are not collected at the time of purchase. Members agree to comply with all federal, state, and local laws related to the purchase, transport, and installation of products.

6. Intellectual Property

All photographs, product descriptions, and brand marks remain the property of ARKA Living or its licensors. Members may use ARKA Living imagery only for the purpose of presenting products to clients and must credit ARKA Living whenever images appear in public‑facing media.

7. Communications

By joining, members consent to receive emails and other electronic communications regarding Trade Program news, exclusive events, and product launches. Members may opt out of marketing messages at any time, but transactional or program‑critical notices will continue as long as the account remains active.

8. Returns and Claims

Custom and made‑to‑order pieces are final sale. For stock items, members must inspect deliveries upon receipt and notify ARKA Living in writing of any damage or defect within three business days. Failure to do so constitutes acceptance of the goods as delivered.

9. Program Modifications and Termination

ARKA Living may amend these Terms and Conditions, adjust discount levels, or discontinue the Trade Program at any time with or without prior notice. ARKA Living may suspend or terminate a membership immediately for misuse of benefits, inaccurate information, or other conduct deemed inconsistent with the integrity of the program.

10. Limitation of Liability

In no event will ARKA Living be liable for any indirect, incidental, or consequential damages arising out of or in connection with the Trade Program or the purchase or use of any product, even if advised of the possibility of such damages. ARKA Living’s aggregate liability shall not exceed the amount paid by the member for the specific product giving rise to the claim.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas without regard to conflict‑of‑law principles. Any dispute arising under or relating to the Trade Program shall be resolved exclusively in the state or federal courts located in Harris County, Texas.
